These Terms of Service (“Terms”) govern your use of Bitrack, the online workspace for client work available at https://bitrack.app and its app (the “Service”). It is provided by Bitrack (“Bitrack”, “we”, “us”). By creating a workspace, accepting an invitation or otherwise using the Service, you agree to these Terms. If you use the Service on behalf of a company, you confirm that you may bind that company, and “you” means the company.
1. Accounts and workspaces
- You must be at least 18 years old and give accurate information when you sign up.
- The person who creates a workspace is its Owner. The Owner decides who is invited, what each person can see and do, and is responsible for the workspace and for everyone they invite.
- Keep your password confidential and tell us promptly at [email protected] if you believe your account has been compromised. You are responsible for activity under your account.
2. Early access and fees
Bitrack is currently in early access and is free. Access is given by invitation: you request it on our website, and we send a link to create your workspace. We plan to introduce paid plans later. We will tell workspace Owners at least 30 days before any charge applies, and nothing will be charged without your agreement to a plan. During early access, features may change, be added or be removed as the product develops, and we welcome your feedback.
3. Your content
- Everything you and your team put into Bitrack (clients, projects, tasks, files, proposals, contracts, credentials, messages and the rest, “Your Content”) remains yours.
- You give us permission to host, store, back up, process and display Your Content only as needed to provide, secure and support the Service for you. We do not sell Your Content or use it for advertising.
- You are responsible for Your Content and for having the right to use it. Where Your Content includes personal data about other people (for example your clients, their staff or people who submit your lead forms), you are the controller of that data and we process it on your behalf, as described in our Privacy Policy.
4. Acceptable use
You agree not to, and not to let anyone else:
- use the Service for anything unlawful, fraudulent or harmful, or to store or share content you have no right to;
- send spam or unsolicited messages through the Service, including through client e-mails, invitations or lead-form auto-replies;
- upload malware, or try to probe, scan, overload or break the security or other workspaces of the Service;
- store credentials or secrets you are not authorised to hold;
- copy, resell or reverse-engineer the Service, or get around its limits or access controls.
We apply reasonable limits (for example on sign-ups and on e-mails sent per workspace per day) to protect the Service and its users.
5. Proposals, contracts and e-signatures
Bitrack provides tools to prepare proposals and contracts and to collect electronic signatures, together with a record of who signed, when and from which device. Contract templates and wording are provided as a starting point and are not legal advice. You are responsible for the content of your agreements and for confirming that electronic signatures are suitable for them under the law that applies to you and your clients.
5a. Client portal and connected services
A workspace can invite its clients’ people to its client portal. The workspace decides who is invited and what they can see, and is responsible for that access. If you connect a third-party service (for example Google Calendar or Outlook), your use of that service stays subject to its own terms, and you can disconnect it at any time.
6. Credentials vault
Secrets in the credentials vault are encrypted, and access is controlled by the workspace Owner. You are responsible for deciding who is given access and for keeping the stored credentials up to date. Do not use the vault as the only copy of a credential you cannot afford to lose.
7. Availability, backups and support
We work to keep the Service available, secure and backed up, but during early access we do not guarantee any particular uptime and the Service is provided without a service-level agreement. We may carry out maintenance and updates, and we will try to keep interruptions short.
8. Ending your use
- You may stop using the Service at any time. A workspace Owner can ask us to export or delete the workspace by writing to [email protected].
- We may suspend or close an account or workspace that breaches these Terms, puts the Service or other users at risk, or where the law requires it. Where reasonable, we will warn you first and give you the chance to export Your Content.
- After a workspace is deleted, its data is removed from the live Service and disappears from our encrypted backups as they expire, as described in the Privacy Policy.
9. Disclaimer
To the extent the law allows, the Service is provided “as is” and “as available”, without warranties of any kind, express or implied, including fitness for a particular purpose and non-infringement.
10. Limitation of liability
To the extent the law allows, we are not liable for indirect, incidental, special or consequential losses, or for loss of profits, revenue, data or goodwill. While the Service is free, our total liability for all claims relating to the Service is limited to USD 100. Nothing in these Terms limits liability that cannot be limited by law, such as liability for fraud or gross negligence.
11. Indemnity
You agree to compensate us for claims, losses and reasonable costs arising from Your Content or from your breach of these Terms or of the law.
12. Changes to these Terms
We may update these Terms as the Service evolves. If a change is significant, we will tell workspace Owners by e-mail or in the app before it takes effect. Continuing to use the Service after the change means you accept the updated Terms.
13. Governing law
These Terms are governed by the laws of the Hashemite Kingdom of Jordan, and the competent courts there have jurisdiction, unless the law of the country where you live as a consumer gives you rights that cannot be waived.
